These general terms and conditions, as may be amended from time to time, apply to all our services directly or indirectly (through distributors) made available online, through any mobile device, by email or by telephone. By accessing, browsing and using our website or any of our applications through whatever platform (hereafter collectively referred to as the “website”) and/or by completing a reservation, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below (including the privacy statement).
These pages, the content and infrastructure of these pages, and the online accommodations reservation service provided on these pages and through the website (the “service”) are owned, operated and provided by 7Dreams.es (“7Dreams.es”, “7dreamsapartments.com”, “us”, “we” or “our”) and are provided for your personal, non-commercial use only, subject to the terms and conditions set out below.
The purpose of this document is to establish and regulate the standards for the use of and to safeguard the data contained in the site www.7dreamsapartments.com (henceforth the Website). The Website is understood to comprise all the pages and content owned by SEVEN DREAMS HOUSING SERVICES S.L. accessed via the domain www.7dreamsapartments.com, and its sub-domains. The owner of this Website is SEVEN DREAMS HOUSING SERVICES S.L., with registered address calle Santaló 71, Barcelona, registered in the Barcelona Register of Companies, volume 45114, Folio 184, Sheet 477254, Inscription 1, with Taxpayer ID number B-66663220 (henceforth Barcelona Apartment). Seven Dreams Housing Services SL uses the Website to provide information, room reservation, employment search and any other services that it considers necessary for the correct execution of its corporate purposes. These general conditions regulate the use of the Website service that Seven Dreams Housing Services SL makes available to users of the Internet. The use of the Website implies the full acceptance, without reservations, by the person using it (henceforth the User) of each and all of the General Conditions contained in the version published by Seven Dreams Housing Services SL at the time the Website is accessed by the User, who must therefore be aware of the importance of reading them each time he/she visits the Website. The action of accessing this Website implies knowledge and acceptance of the following General Conditions. Seven Dreams Housing Services SL therefore recommends that the User print or download them and read them carefully each time he/she accesses the Website. The use of the Service is also subject to any warnings, rules of usage and instructions given to the User by Seven Dreams Housing Services SL in addition to those included in these General Conditions insofar as the User does not object to them.
2. Scope of our Service
Through the website, we (7Dreams.es and its affiliate (distribution) partners) provide an online platform through which temporary accommodations can advertise their apartments for reservation, and through which visitors to the website can make such reservations. By making a reservation through 7Dreams.es, you enter into a direct (legally binding) contractual relationship with the accommodation provider at which you book. From the point at which you make your reservation, we act solely as an intermediary between you and the provider, transmitting the details of your reservation to the relevant accommodation provider and sending you a confirmation email for and on behalf of the accommodation provider.
When rendering our services, the information that we disclose is based on the information provided to us by accommodation providers. As such, the accommodation providers are given access to an extranet through which they are fully responsible for updating all rates, availability and other information which is displayed on our website. Although we will use reasonable skill and care in performing our services we will not verify if, and cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our website or otherwise), inaccurate, misleading or untrue information or non-delivery of information. Each accommodation provider remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information (including the rates and availability) displayed on our website. Our website does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level, qualification or (star) rating of any accommodations made available.
Our services are made available for personal and non-commercial use only.
Therefore, you are not allowed to re-sell, deep-link, use, copy, monitor (e.g. spider, scrape), display, download or reproduce any content or information, software, products or services available on our website for any commercial or competitive activity or purpose.
3. Use of the website on line reservation services
The purpose of these services is to enable customers to reserve apartments. The use of these services implies the full acceptance, without reservation and agreement to each and all of the general conditions contained in the most recent version of these general conditions.
3.1 Accommodation Listings
All the listings of the site, application and services are checked and created by 7DREAMS, never by Landlords or any other user. The Landlords can list their properties at any time by informing the 7DREAMS team and arranging with them a photography session in which 7DREAMS checks the basic features of the Accommodation. The Landlord agrees to let the 7DREAMS team enters into the property in order to take pictures, make floor plans, videos and any other marketing material that 7DREAMS requests. The property needs to have a valid physical address. The Landlord agrees to provide all the information necessary and asked by 7DREAMS including, but not limited to, the location, capacity, size, features, availability of the Accommodation and pricing and related rules and financial terms. The listings are written by a qualified member of the 7DREAMS team, never by the Landlord. The creation of listings is free of charge for the Landlord. Once, the listing is done, we will publish its publication. By publishing the publication of the listing, the Landlord agrees and accept these Terms. The Landlord understands and agree that once the Tenant books the Accommodation, the price of such booking may not be altered. In case that the Landlord alters the price, the Tenant will have the right to cancel the booking. The Landlord understands and agrees that 7DREAMS does not act as an insurer or as a contracting agent for you as a Landlord. If a Tenant books a Landlord’s Accommodation and stays at that Accommodation, any agreement the Landlord enters into with such Tenant is between the Landlord and the Tenant, the Lease Agreement, and 7DREAMS is not a party thereto.As a Landlord, you are responsible for your own acts and omissions.
7DREAMS recommends that Landlords obtain appropriate insurance for their Accommodations. Please review any insurance policy that you may have for your Accommodation carefully, and in particular please make sure that you are familiar with and understand any exclusions to, and any deductibles that may apply for, such insurance policy, including, but not limited to, whether or not your insurance policy will cover the actions or inactions of Tenants (and the individuals the Tenant invites to the Accommodation, if applicable) while at your Accommodation.
3.2 Contract Conditions
The User, on using this service, will receive a confirmation e-mail containing a PRE RESERVATION FORM for the reservation. Once the payment of the fee is done, then the apartment will be rented.
3.3 Use of the Services
The User agrees to use the services in accordance with the precepts of legality, morality, accepted custom and public order and in accordance with these General Contract Conditions. The User may not, therefore, use the services for any purpose that is illegal and/or contrary to that established in these General Contract Conditions, which harms the rights or interests of a third party in any way, or which may in any way damage the services, Seven Dreams Housing Services SL, and/or its image, or hinder the correct functioning of the services that it offers or may offer in the future.
4. Responsability of the user
Please note that, as stated above, the site, application and services are intended to be used to facilitate the booking of accommodations. 7dreams checks every property listed on the site, application and services and takes photos and other information from the accommodation at the date of taking them. as the accommodations are checked, all the visual and any other information of the accommodation is real and accurate on that date. the condition, legality or suitability of any accommodations correspond to that date, regardless the date when the tenant books the accommodation. 7dreams is not responsible for any disclaims and all liability related to any and all listings and accommodations. accordingly, bookings are be made at the tenant’s own risk.
4.1 Limitation of Liability
7DREAMS SL is not liable for any direct or indirect incident that may occur as a result of the use of the apartment, including damages without limits, insurance, losses due to fire, theft or criminal behaviour.
4.2 Respect the Neighborhood
Please note that the rules regarding genes caused by loud music and parties are very clear: BOTH ARE STRICTLY PROHIBITED. There has been an order issued from the Mayor of Barcelona for all tourist apartments and the effect of economic sanctions are imposed. These sanctions may even increase if the closure of tourist apartments do not meet these conditions. Please be aware that parties, nocturnal disturbance (noise, music), neighbour complainants, or police reports may result in immediate dismissal from the apartment without compensation.
By signing the contract at check-in, you and all persons accompanying pledge to have a decent and proper behaviour throughout the duration of your stay. If one of you does not behave properly and responsibly, 7DREAMS reserves the right to ask you to leave the apartment without any compensation or compensation.
This will also involve the loss of rent that has already been paid. Please remember that booking an apartment with 7DREAMS means that you accept our rules and conditions. Therefore, we will expect you to adhere to these rules. In addition, you must sign such commitments at check-in.
Hours of rest are all the days of 22.00h to 10.00h. The User is exclusively responsible for accessing the Website. The User assumes entirely and exclusively all risks which may be associated with the use of the Website. 7DREAMS SL provides no guarantee with respect to the following: the reliability, availability, continuity, absence of faults and security of the Website; that the contents of the Website and any information transferred via the Website is free of viruses or other harmful items; that the use made by the User of the Website is secure.
7DREAMS SL accepts no responsibility for any damage or harm derived from any interference, omission, interruption, computer virus, telephone service failure or disconnection affecting the operation of this electronic system that occurs as a result of causes beyond the control of Barcelona Apartment; for any delays or blockages in the use of this electronic system due to deficiencies or overloads in its Data Processing Centre, telephone lines, the Internet system or other electronic systems; or for any damage caused by third parties illegally entering the system beyond the control of Se SL. Accessing the Website does not imply any commercial relationship between 7DREAMS SLt and the User.
5. Booking Process
This section applies only to the apartments that are rented through 7DREAMS directly.
The Tenant will send to us some information inquire. We will ask the tenant his/her preferences in order to look for some apartments that match with the tenant criteria. Depending on the preferences and availability, 7dreams will send a shortlist of apartments. If the tenant decides to book one of this apartments then the process will be:
- We will make sure the availability of the apartment selected for the time selected. Sometimes between the shortlist and the booking request the availability of the apartents can change so we will check it again.
- Once the availability is confirmed we will send a PRE RESERVATION FORM. In this form we will ask for some personal details: name and surname, passport number, address, name of the other tenants if necessary. We will also give you our account number in order to pay the fee. At this stage, we will BLOCK the apartment 24h
- If we received the payment of our fee then we will BOOK the apartment on the dates selected
At this point we will contact the landlord to contact you in order to prepare your arrival. We always ask to be in copy of all the emails between the landlord and the tenant so we can manage all situations.
All the prices displayed on 7DREAMS are monthly price.
When the Tenant makes a booking, the amount that we will require is the Booking Fee.
The Booking fee is a percentage of the total contract value plus the Value Added Tax.
Landlord and Tenant sign a private tenancy agreement, whatever is its formality, and whatever method was used in order to do so. It can be via email, fax, or any other telematic ways the Landlord prefers or suggests.
24 hours after the Tenant moves in according to the “check-in” section described below.
In any case, the Landlord is the one that determines, on its own discretion, the monthly rental price and any other fees to be included in the rental price or not such as utilities, internet, etc.
5.2 Bank Transfers
If you do a bank transfer, in order for us to proceed with your booking request we need you to specify the confirmation code of your PRE RESERVATION FORM (to be found in the email you shall receive): xxxxx and the name you used in your booking request xxxxx. Please also send us an email to firstname.lastname@example.org with a copy or screenshot of the transfer made.
. When we finally receive your bank transfer, you will be notified by email.
Please note that 7DREAMS will not be responsible for the cost of any refund made via bank transfer and that any bank fees involved in the transfer will be subtracted from the total amount.
6. Cancellation policies
6.1 Cancellation policies for Landlords
The Landlord can, always after he/she has confirmed the Booking, cancel that Booking depending on the following terms:
In case that the Booking has been confirmed by the Landlord, and both Landlord and Tenant have signed a private lease or tenancy agreement, whichever is its form, the cancellation policies are those contained in that private lease or tenancy agreement in which, in any case, 7DREAMS is not a party. In any case, if the Landlord cancels before the Tenant moves in, the Landlord shall refund all the money sent in full to the Tenant,
In case that the Booking has been confirmed by the Landlord, and both Landlord and Tenant have not signed a private lease or tenancy agreement, whichever is its form, providing that the Landlord accepted and confirmed the Booking, if the Landlord cancels the Booking before the check-in date or before Tenant and Landlord signed a private tenancy agreement, the Landlord will refund all the money sent in full back to tenant.
EXCLUSION OF RIGHT TO WITHDRAW AND CANCELLATION OF PRE-CONTRACT
European Union legislation provides users with a right of withdrawal upon entering into an online agreement (distance selling). The right of withdrawal shall be excluded after full performance of 7DREAMS’s service. 7DREAMS’s service is fully performed once a landlord has accepted a booking request by a user.
The potential 7DREAMS user hereby declares the following: “I hereby explicitly consent that 7DREAMS immediately starts performance of the service by forwarding my service request to a landlord before my statutory right of withdrawal ends. I am fully aware that I will lose my right of withdrawal as soon as 7DREAMS fully performs the agreement, i.e. upon acceptance of my service request by the landlord.”
The potential 7DREAMS user has the right to withdraw from a pre-contract without giving a reason and before signing a lease contract with the landlord. The withdrawal has to be declared in writing via e-mail to help@7DREAMS.com. In this case, the potential 7DREAMS user will be refunded in accordance with our cancellation policies for tenants.
6.2 Cancellation policies for Tenants
If you, as Tenant, cancel the requested booking before the requested booking is confirmed by the Landlord, 7DREAMS will cancel any pre-authorization to your credit card, paypal account and/or refund any nominal amounts charged to your card in connection with the requested booking within a commercially reasonable time.
If the Booking has been confirmed and the Tenant cancels, the Booking Fee will never be refunded by 7DREAMS. In fact, in any case, unless exceptional circumstances or if the Landlord cancels the Booking according to provisions contained above, 7DREAMS will, on its own discretion, refund the Booking Fee.
There are three (3) cancellation policies for Tenants which the Landlord can select, on its own discretion. The Cancellation policy selected will be shown on the listing. If the listing does not show any cancellation policy, the Standard one of below applies. This cancellation policies apply in the absence of a private tenancy agreement already signed between Landlord and Tenant. If that was the case, the cancellation policies to apply are those contained in that private Lease Agreement. Also, the listing might content the lease agreement to be signed when checking in, in which case, the cancellation policies on it will apply though the lease agreement has not yet been signed.
In the absence of a private Lease Agreement signed between Landlord and Tenant of which 7DREAMS is not party, and always after the Booking was confirmed by the Landlord according to the provisions explained above, the 3 possible cancellation policies are:
FLEXIBLE. If the Tenant cancels the booking:
less than 3 days prior the check-in date, 7DREAMS will not refund the amount already captured after the booking confirmation. Thus, the Tenant will lose the Booking fee.
between 3 days and 30 days before the check-in date, 7DREAMS will refund50% of the Booking fee.
more than 30 days before the check-in date, 7DREAMS will refund the 100% of the booking fee.
STANDARD. If the Tenant cancels the booking:
less than 30 days prior the check-in date, 7DREAMS will not refund the amount already captured after the booking confirmation. Thus, the Tenant will lose the Booking fee.
between 30 days and 60 days before the check-in date, 7DREAMS will refund 50% of the booking fee.
more than 60 days before the check-in date, 7DREAMS will refund the 100% of the booking fee to the tenant.
STRICT. In any case, whenever the Tenant cancels the Booking, 7DREAMS will not refund any amount received by the Tenant.
For the avoidance of doubt, the Landlord is the only one, on its own discretion, who selects the cancellation policy and 7DREAMS takes no responsibility in that decision.
In case, the Landlord does not select any of the 3 cancellation policies, meaning that the policy selected is not reflected in the listing, the Strict policy applies by default.
Indication of Cancellation
1) If the Tenant wants to change or modify the conditions of the booking confirmed, it will be considered as a cancellation of the booking. This cancellation will apply the rules above.
2) The Tenant could give an indication of its desire to cancel the booking by phone, email, whatsapp, or by any other way, it will be an indication of the desire of cancelling the booking. Therefore, the 7DREAMS team will send an email to the Tenant reflecting the fact that led to that indication and will give to the Tenant 24 hours to either confirm the cancellation or otherwise the Booking. If the 7DREAMS team does not receive any of both confirmations or instructions, the Booking will be automatically cancelled and the cancellation policy will apply transferring to the Landlord the corresponding amount. In case that the indication occurs within 48 hours before 9 a.m. of the check-in date (local time), the limit time to confirm the cancellation or otherwise booking is 48 hours before of check-in date, meaning 9 a.m. (local time) of the day before the date of the check-in.
7DREAMS SL reserves the right to prevent or prohibit access to the Website by any User who enters any information on the Website that contravenes the law or which is immoral, reserving the right to take such legal action as it considers appropriate to prevent such conduct.
8.1 C orrect use of the contents of the web
All the content accessible on the Website including but not restricted to, text, graphics, logos, icons, images, audio clips, databases and software and their compilation (Intellectual Property) is the property of 7DREAMS SL, its sponsors, shareholders and licensors and is protected by intellectual property law.
Barcelona Apartment declares that the industrial property rights (brands, trade names, etc.) that appear in this Website are its property and/or are protected by current Industrial Property law.
The User is obliged to use the Website diligently, correctly and legally and, in particular, undertakes not to:
- Suppress, conceal or manipulate the copyright notice, brands or other data which identify the rights of their owners ( 7DREAMS SL or any third party) forming part of the contents and/or products sold through the Website or any technical devices to protect data, digital fingerprints or other data mechanisms they may contain.
- Use the contents and, in particular, information on 7DREAMS SL obtained from the Website to send mail shots, direct marketing or other types of commercial communication or unsolicited messages to large numbers of people.
- Reproduce, copy, distribute, transform or modify the contents, or allow the public to access the contents via any form of public media, without the consent of the owner of the corresponding rights or where legally permitted.
- In general, use the contents for purposes or effects that contravene the precepts of legality, morality, accepted custom and public order.7DREAMS SL does not grant any license or authorisation for any type of use of the industrial and intellectual property rights or any other property or right in relation to its Website.
9. Intellectual Property
The intellectual property rights over the works contained in the Website belong exclusively to 7DREAMS SL except where other ownership is expressly indicated. The unauthorised reproduction, distribution, sale or transformation of said works constitutes a breach of 7DREAMS SL intellectual property rights, or of the rights of the owner, and may give rise to such legal or extrajudicial action as may be necessary to enforce said rights.
Any information that the User may access through the Website may also be protected by intellectual, industrial or other property rights. 7DREAMS SL will not be responsible under any circumstances for any breach of said rights committed by the User.
9.1 Data Protection
The User of the services offered through this Website provides personal details voluntarily and expressly and fully accepts, without reservation, that 7DREAMS SL may automatically process these details and store them in an electronic file for the purposes of providing and offering its services. 7DREAMS SL is responsible for this file, which has been registered on the General Register of the Data Protection Agency.
Due to the nature of 7DREAMS SL business and the services it provides, and to ensure its corporate purpose is correctly pursued, it needs to communicate personal details to third parties. This information may be provided to other companies in the 7DREAMS SL chain and to other interested third parties. The communication of personal details to such entities is for the exclusive purpose of ensuring the correct provision of 7DREAMS SL services. The person to whom the details refer has the right at any moment to access the file and may rectify, delete or object to use of the data in accordance with data protection legislation. The User’s consent to process and cede personal details may be revoked at any time, without retroactive effect, in accordance with Articles 6 and 11 of Organic Law 15/1999 of 13 December on Personal Data Protection (LOPD).
To do so, the User must write to the manager responsible for the file at 7DREAMS SL Administration Department, at the company’s head office at calle Providencia 111 , bajos , Barcelona, quoting the reference PERSONAL DETAILS, or by e-mail to info@7DREAMS.com with the same reference. 7DREAMS SL guarantees that it has taken all the necessary security measures to protect its equipment, systems and files. 7DREAMS SL also guarantees the confidentiality of personal details, although it will provide the competent public authorities with personal details and any other information within its power or which is accessible from its systems and which may be required in accordance with applicable legal and regulatory provisions.
The User is responsible for the veracity of the personal details provided to 7DREAMS SL and for communicating any changes to said details.
The services of 7DREAMS SL are not aimed at minors.
Operations to consult the User’s account details or to request services or products through the Website are carried out via a secure server. The software used by said server encrypts the information entered by the User prior to its transmission to 7DREAMS SL.
7DREAMS SL also has strict security procedures with regard to the storage and use of data to ensure that there is no unauthorised access to said data, in accordance with Article 9 of the aforementioned LOPD.
9.2. Applicable law and jurisdiction
These conditions are subject to Spanish law, which will be applicable to all matters of interpretation, validity and execution not expressly contained in these conditions. 7DREAMS SL and the User expressly renounce the right to recourse to any other jurisdiction and agree to be bound by the rulings of the Barcelona courts of law in the event of any dispute arising from the provision of the services covered by these General Conditions.
